November Auto Sales - Business Insider

UPDATE: Toyota announced a 17.2 percent rise in November auto sales from a year earlier, missing analysts' consensus estimate of a 20 percent gain.

--------------

EARLIER:?GM reported monthly auto sales figures well below expectations. The company said sales rose 3.4 percent versus analysts' consensus estimate of 7.6 percent.

Below is an excerpt from the GM release:

?The East Coast?s ongoing recovery from Hurricane Sandy helped drive the November SAAR?materially higher, but it benefited our competitors more than GM, since they rely on the region for more of their sales,? McNeil said.

?It?s clear that the industry will come in at the high end of our full-year sales forecast,? he added. ?Exactly how much growth we can expect next year will depend in part on how Congress and the president resolve the fiscal cliff issue. Consumers hate uncertainty, so an agreement on ways to reduce long-term federal budget deficits could remove an impediment to growth.?

EARLIER:?Ford Motor just released monthly auto sales figures for November, rising 6.4 percent from a year earlier versus expectations of a 2.4 percent gain as the industry continues to recover from the effects of Hurricane Sandy.

Nissan also posted a monster month, with sales up 12.9 percent versus estimates of a 4.8 percent rise.

Below is an excerpt from the Ford release:

November brought growth throughout Ford's product portfolio in the U.S., with car sales up 15 percent, utilities up 2 percent and trucks up 4 percent.??

"November represented a strong month for the industry, and Ford sales performed well across the board," said Ken Czubay, Ford vice president, U.S. Marketing, Sales and Service. "We saw sharp increases in demand for Ford's fuel-efficient small cars, our best-ever month for electrified vehicles and growing demand for our fuel-efficient and capable F-Series pickups."

Ford had its best small car November sales month since 2000, with Focus, the all-new C-MAX Hybrids and Fiesta sales totaling 26,848 vehicles ? a 76 percent increase over last year. Focus sales were up 56 percent versus year-ago levels, while the all-new C-MAX Hybrid lineup gained 52 percent versus October, when the C-MAX Energi went on sale.

The Ford F-Series, America's best-selling vehicle, posted an 18 percent increase, with 56,299 vehicles sold in November. This represents F-Series' best November since 2005 and 16 straight months of year-over-year sales increases.??

Ford's total November sales of 177,673 vehicles increased 6 percent versus last year, with retail sales up 12 percent.

Ford also announced its 2013 first-quarter North American production plan. The company plans to build 750,000 vehicles in the first quarter, up 11 percent (73,000 vehicles) from 2012's first quarter. Fourth quarter production of 725,000 vehicles is unchanged from previous guidance.

ORIGINAL:?All of the major auto manufacturers, including GM, Ford, Chrysler, Toyota, and Honda, report monthly sales figures today.

Chrysler kicked things off this morning, announcing a 14 percent rise in November sales from the previous year. However, analysts were expecting a 16 percent gain.

Nonetheless, it was Chrysler's best November in five years. One executive shrugged off the fiscal cliff in the press release and hinted that Hurricane Sandy still is weighing on sales:

?Even with all the talk of a looming fiscal cliff, Chrysler Group is well positioned for a strong sales finish to the year,? said Reid Bigland, President and CEO ? Dodge Brand and Head of U.S. Sales. ?Our November sales were up 14 percent and we extended our sales streak to 32-consecutive months of year-over-year sales gains. We are expecting a strong December as the industry continues to recover from the East Coast hurricane and consumers continue to respond to our popular year-end Big Finish event.?

Analysts project that November was a blockbuster month for total vehicle sales. The consensus estimate is a rise to 15.00M units sold at a seasonally adjusted annual rate (SAAR), up from 14.22M in October.

We will add sales figures and releases from GM, Ford, Toyota, Honda, and Nissan as they report throughout the day. Click here for live updates >

Toll authority quick to dun drivers; not so good at refunds

A North Texas Tollway Authority bank account contains more than $57,000 collected from customers who have overpaid their ZipCash bills.

By Scott FriedmanNBCDFW

The North Texas Tollway Authority is quick to send drivers a bill for using toll roads in North Texas, but the agency is not so fast in tracking down customers when it owes them money.

An NBC 5 investigation has discovered that money from drivers who overpay on ZipCash bills is deposited into what the NTTA calls the Overpayment Account -- not refunded or credited toward a future trip on a toll road.

The NTTA has not previously made the bank account public. It contains more than $57,000 collected from ZipCash users who have overpaid.

NTTA toll roads are cashless. Drivers without TollTags are billed by ZipCash, the agency's pay-by-invoice system.

The NBC 5 Investigates team filed an open records request to find out how many people have money sitting in the account. The list of names is more than 950 pages long.

The list NTTA provided to NBC 5 Investigates did not include any identifying information beyond the drivers' names.

Haskell Tilson's name appears on the list. NBC 5 Investigates got Tilson's license plate number and sent it to the NTTA to confirm that he is the same person with money in the overpayment account.

Tilson's $2.22 in the account is certainly not a lot of money, but he said it's the principle that concerns him.

"Why don't they just credit it to the next bill or be honest about it and just send me a check for $2.22?" he said.

While the agency spends money sending bills to collect small toll amounts, the NTTA doesn't want to spend money to send out small refunds.

"And if that costs more to return it, we can't be using dollars to chase dimes," NTTA spokesman Michael Ray said. "That's not a good use of toll-payer money. They expect us to be good stewards of their money."

Watch NBCDFW.com's video report on the toll authority

Drivers have no way of knowing if their money is stuck in the overpayment account. Even though NTTA posts lists of people who owe the most in tolls, it has never publicly shared the list of people stuck in limbo.

NBC 5 Investigates asked Rey why the NTTA won't post the list and let people know about the account so they can call and ask that the money be credited to their ZipCash account.

"Well, because I think it makes good financial sense not to be starting a conversation over money that would cost us more to refund than it would be to send," he said.

While the money sits in the NTTA's hands, the agency is collecting interest on the $57,812.42 currently in the overpayment account.

The NTTA said it would refund money to customers with more than $2.50 in the overpayment account. But NBC 5 Investigates found that more than 1,500 people who are owed more than $2.50 have not received a refund or credit.

The NTTA claims it did not have enough information to find those people or set up an account for them.

If the money isn't claimed within three years, it will be sent to the Texas State Comptroller's unclaimed property division, which may ultimately notify people about their missing money.

The comptroller publicly posts a list of people with money in its account.

The tollway authority said it's just not worth the agency's time to post its own list because most of the people on the list are owed only pennies.

"And, honestly, that's what this is -- it's a lot of nickels and dimes, a lot of pennies and two cents," Rey said.

The NTTA says there is currently $57,812.42 in the overpayment account.

Search the NTTA overpayment database

The account was created in August of 2009. But the NTTA has only provided NBC 5 Investigates with a detailed spreadsheet documenting transactions from May 2010 to Nov. 26, 2012.

Customers who find their names on the list can call the NTTA customer service center at 972-818-NTTA (927-818-6882). The agency says it will credit the money to their account if the customers can provide proper identifying information.?

China warns North Korea about rocket test plans (+video)

North Korea, a longtime Chinese ally, plans to launch a long-range rocket later this month, raising tensions with the US and South Korea.?

All sides should work for stability and avoid acts that raise tensions, the Foreign Ministry said in a brief statement. It acknowledged?North?Korea's?right to the peaceful use of outer space, but said that had to be harmonized with restrictions including those set by the United Nations Security Council.

"We hope all relevant parties will do that which benefits peace and stability on the Korean Peninsula, hope all sides will respond calmly and avoid exacerbating the situation," ministry spokesman Qin Gang said in the statement.

The?North?Korean launch, set for Dec. 10 to 22, is likely to heighten already strained tensions with Washington and Seoul as South?Korea?plans to hold a presidential election on Dec. 19 and President Barack Obama prepares to begin his second term.

It would be?North?Korea's?second launch attempt under leader Kim Jong-un, who took power following his father Kim Jong-il's death nearly a year ago. That first launch eight months ago earned?North?Korea widespread international condemnation, despite ending in an embarrassing misfire.

Beginning your own multi-level marketing business may be easier than finding a part-time job. It is difficult to start a small business, but as you network, you can start to be profitable. This article includes powerful tips on starting and succeeding in MLM.

Consult digital resources like online discussion boards and forums for advice and insight into multi-level marketing. These forums have experts who generously share their knowledge, as well as people who are just getting started. You can learn something from everyone. You might also meet potential partners or create business connections on these forums.

Always nod your head when talking to a multi-level marketing lead; never shake it. Your body language has to be just as positive as your choice of words. )

TIP! Schedule time to relax with friends and family which can help take away some of the business stress you are dealing with. In the beginning, expect that your business will demand more of your time.

Research and apply the best methods for finding new clients. Your goal should be to get new customers and solid leads. Limiting yourself to your inner circle of friends and family will limit your potential for growth and profit. You must put in the effort to find clients outside of those you already know so that you can allow new possibilities in your doors.

It?s important to spend as much time as possible on seeking out new leads. This is the method that generates the most money. While the other aspects of your day, such as reading your emails and going to meetings, are an important part of having a business, they don?t actually make you money. Making your money revolves primarily around obtaining leads and closing those leads.

Research compensation plans for the various types of multi-level marketing opportunities that you are considering. Focus on generating higher returns from more than one source of income. Make sure you refer your sale to your sponsors. This is actually a good thing because it gives you leverage, and your sponsor should be helpful to you.

TIP! Having a monthly budget is important. Do some research to find out the requirements for your initial investment.

Look at what other multilevel marketing professionals are doing and learn from their successes. Before long you will be acting and thinking with the same mindset as those independent distributors and your success rate should dramatically improve.

Business Plan

Know your business plan backwards and forwards, but be flexible enough that you won?t be lost if you miss an appointment or something bad happens. Be aware of what needs to be done each month, and then adjust this according to what you are actually capable of doing. Use your business plan to calculate a satisfactory and profitable goal from the gap between these two numbers.

TIP! Try and emulate the characteristics of independent distributors when dealing with network marketing. By emulating these role models, you can enhance your ability to act and think the way that they do, thereby increasing your successfulness.

When doing multilevel marketing, it is critical that you are an expert, which means you are very knowledgeable about your product. When you care about your product and show passion for it, this passion will show to everyone you come into contact with. People will also be more willing to join your downline if they see how passionate you are about your products. Learning about the product makes it easier to give honest, sincere reviews that your potential clients will appreciate.

Investigate a company with the BBB before you give any money to a marketing business. There are always a few bad apples in the bunch. Do not be hasty. Make sure that the investment you are making is smart. Check things out with a company, like the BBB, who has reviews of other companies.

By joining online forums you can participate and learn a lot of information from others. These forums can provide valuable tips and information on network marketing, and as a bonus, they are free. Do an Internet search and find a forum that you enjoy, and spend a little time there each day picking up tips from others in the business.

TIP! Everyone is egotistical to some extent, and that means we like talking about ourselves. This gives you an opportunity to learn what makes you customers tick.

Network Marketing

Treat your network marketing as a business at all times. When it comes to your networking profit potential, you get what you give. You must put in a lot of time and effort if you hope to do well in network marketing. You have to make a promise to yourself that you?ll work extremely hard every day, and you?ll be well on your way to success with multi-level marketing.

Multilevel marketing utilizes individuals already within your own firm to make contacts and form a larger network of helpful business partners. Assemble a team of spokesmen who speak highly of your company, and get them talking to everyone they know about the benefits of your products. This is the ultimate model in networking success.

TIP! Have a strict business plan, but be flexible in case of unexpected occurrences and a few missed deadlines. Figure out how much you have to do and how much you can actually do in a given time frame.

Making sure you put your customers first is a must in MLM. Without it you?re nothing; the customers are what make you successful. If your customers are not happy, your business definitely will not succeed. Only talk about 20% of the time. Spend the other 80% of the conversation listening.

Even the largest companies have recognized the potential of network marketing, and may choose yours to reach out to people. Use these tips to become a successful network marketer.

Castle in the Sea: Homeschooling High School: Math

Well, this should be short.

I am not a math person. Some of my children are not math persons. Others of them are. Over the years, as I have dealt with both math persons and non-math persons, in the context of having to launch them, eventually and more or less single-handedly, into the rest of their lives, I have distilled my philosophy of math education to the following single word:

Whatever.?

*

OK, that's not really acceptable as a philosophy of anything. Try again.

*

I have often observed that one of the real advantages of homeschooling is the way that it gives the student opportunities to struggle honestly with something difficult and not (ultimately) fail. That is, the student may fail the first time, or the fifth time, but because we're not rushing on to the next thing, we can count those as attempts toward a summit of mastery. We work at what doesn't come easily to us until we can get it at least acceptably right, and the getting it right is what we count in the end. Nobody says, Oh, you didn't climb Mount Everest that time; ?obviously you're a loseroid at climbing, generally, and will never climb anything ever. Maybe you're a hole-digger, have you ever thought of that??

Homeschooling also means that what works for one child does not have to work for the next, that a "good" curriculum is only as good as the good it does that student.

*

Thus far I have educated one person who would not voluntarily touch anything mathematical with a ten-foot pole, and one person who embodies the title of a book I picked up once at a library sale: ?A Romp Through Mathematics. The only thing that really worked for the former student was the Teaching Textbooks series, which I wish I had bought sooner than I did, because it would have saved us endless algebraic angst early on. She could self-teach, which was what she wanted, and while various mathematically-inclined friends of mine have opined that the program lacks depth and rigor, it was the right choice for a student who was, as my own college math professor put it, "not making a career of mathematics." In this instance, the question was not whether the student was going to learn mathematics deeply enough; ?it was whether she was going to learn mathematics at all. My own experience has been that it is, truly, entirely possible to spend fourteen years in school and not learn mathematics at all; ?as a parent?I was eager that my daughter not relive that part of my life. Teaching Textbooks was the answer in this instance, and while her standardized test scores in mathematics were not that impressive, she did pass her one college math class (Euclidian and Non-Euclidian Geometries) with a B+, which we both regarded as a highly satisfactory closure to the mathematical chapter of her story.

My second child, and current high-schooler, began working through Saxon Algebra 1/2, which I'd picked up off a freebie table at a homeschool-support-group meeting,?as a sixth grader. I have never been particularly a fan of Saxon and have always said, Hear hear, when people have described it as dull, dry, repetitive, and so on. Saxon looks to me the way math classes felt?to me. Brrrr. Prickly. Unfriendly. Inhuman.?No, thanks.?My son, on the other hand,?credits Saxon with awakening him to the enjoyment of math. He is also very much a self-teacher, and my approach to his math has been to buy the Saxon books, because that's what he's requested, and to find some video-teaching component to accompany them, either the D.I.V.E. CDs or the Art Reed DVD class lectures, for the times when he gets stuck. He also leans heavily on Khan Academy?for help when he needs it. Thus far he has not needed actual tutoring in math, though we do have access to a college tutoring center.

He has so far worked through Saxon's Algebra 1/2?and Algebra 1, and is currently in Algebra 2. Though, supposedly, the two algebras are supposed to cover geometry as well, I've had him do as much of Teaching Textbooks Geometry as he could get through last summer, for the sake of dealing with proofs, and he will probably finish that course next summer (Because we already own it, that's why). From there he will either move into Saxon's Advanced Mathematics or begin taking classes at the college, as math professors advise us. His ultimate interests have to do with science, and it will behoove him in high school to take as much math as he can as well, to be a strong candidate for the kinds of things he wants to do in the future.

*

Unlike me, my friend Anne-Marie is a math person, and I rather suspected that her philosophy with regards to mathematics would not be whatever. I was glad that she responded to a plea for input on this subject with the following:

Soyuz rocket blasts off from French Guiana

KOUROU, French Guiana (Reuters) - A Russian-made Soyuz rocket blasted off from French Guiana on Saturday and placed into orbit an Earth observation satellite for France, space officials said.

It is the fourth time that Soyuz, which first flew in 1966 and traces its roots back even further to the earliest Cold War intercontinental ballistic missiles, has been launched from outside its former Soviet bases.

The rocket lifted off at 11:02 p.m. (0202 GMT on Sunday) from a launch pad at Europe's space base near Kourou, French Guiana, on the northeast coast of South America.

A first launch attempt on Friday was scrubbed due to a technical problem.

After a 55-minute flight, the Pleiades 1B, a one-ton observation satellite ordered by the French Space Agency (CNES) that will used extensively by the French defense ministry, separated from the rocket.

It will also be used by Spain's defense ministry as well as by civilian and commercial customers.

Billed by CNES as "a significant improvement in technology over previous generation satellites," Pleiades 1B is designed to relay to Earth high-resolution images as small as 70 centimeters (27 inches) from a 20-km (12-mile) wide Earth scan.

"It (Pleiades) is an innovative concept in that we share resources but we are able to separate the content for confidentiality," Lionel Peret, head of the Pleiades program for CNES, told Reuters.

It is the second of two satellites in the Pleiades series. The first was launched in December 2011.

European aerospace giant EADS Astrium was the prime contractor for the satellite.

PST: 'Fever factor' cranked to 11 in playoffs today

Major League Soccer will suffer no shortage of atmosphere at the grounds today during the pair of conference final second legs.

According to The Washington Post, officials at RFK Stadium have only a few seats remaining to fill the downsized capacity of 19,647 ? which means the lower bowl will be stocking stuffed and on full hop. They will open those upper decks for the title match if United wins, which would mean room for about 45,000. It would be the third time RFK has hosted an MLS Cup, the most recent coming in 2007.

Untied wasn?t part of that one, but certainly was involved in 1997, when more than 57,000 made the cold and rainy scene as United defeated Colorado. Why would so many endure the conditions for the title of a two-year-old league? Post writer Steven Goff explores that very question in a good piece on the club?s special relationship with its fans.

For sure, the faithful from La Barra Brava, the Screaming Eagles, La Norte and the District Ultras will have the place jumping for Sunday?s 4 p.m. ET kickoff.

(MORE: ProSoccerTalk?s Eastern Conference match preview)

Not that the night?s second match will suffer by comparison. CenturyLink Field on the edge of Seattle?s downtown scene long ago became the league?s attendance standard bearer. The Sounders? average attendance this year, 43,144, set a league record for the fourth year running. ?Here?s a little more perspective on those showy figures.

The point here is that there is absolutely no reason to see a drop-off today. In fact, Sounders fans seem to be rallying around the valiant, difficult fight ahead against the Galaxy. With over 43,000 seats already sold, Seattle will establish a new playoff attendance record today.

No question that rave green and just plain raving will be the order of the day downtown in Seattle.

Asia the focus of Obama's first post-election trip

Jewel Samad / AFP - Getty Images

President Barack Obama boards Air Force One at Andrews Air Force Base in Maryland on Saturday en route to Bangkok, the first leg of his three-nation Asia tour. Obama hopes to demonstrate rising US clout in Asia on his first foreign trip since his re-election, with a tour of three countries including a once unthinkable stop in changing Myanmar.

By NBC News wire services

BANGKOK - President Barack Obama kicked off a three-country Asia tour with a visit to Thailand on Sunday, using his first post-election trek overseas to try to show he is serious about shifting the U.S. strategic focus eastwards.?

Obama's schedule was packed with cultural sightseeing, a royal audience with Thailand's king and a private meeting with the country's prime minister, a joint press conference and an official dinner.

But his attention will be divided during his travels as he faces a simmering crisis in the Gaza Strip pitting Israel against Hamas militants and also contends with a looming fiscal crisis at home.?

'Some indications' Hamas-Israeli truce is possible, Egypt says

Obama's itinerary will also include a landmark visit to once-isolated Myanmar and an East Asia summit in Cambodia as he seeks to?re-calibrate?U.S. economic and security commitments to counter China's influence at a time when America is disentangling itself from wars in Iraq and Afghanistan.?

Capitol Hill leaders sound optimistic notes after fiscal cliff talks with Obama

'Pacific president'
Flying into Bangkok, Obama was due to tour the iconic Wat Pho Royal Monastery and have a royal audience with King Bhumibol Adulyadej at the hospital where he has been recovering from an illness since September 2009. He will also hold talks and a joint news conference with Prime Minister Yingluck Shinawatra.?

Lawmakers, including John Boehner, Nancy Pelosi and Hillary Clinton, unite to present Myanmar democracy leader Aung San Suu Kyi with Congress' highest civilian honor in a ceremony in the Capitol Rotunda.

The U.S. administration regards Thailand as a key ally for advancing an "Asia pivot" that Obama announced last year with an eye to an increasingly assertive China. Obama, who was born in Hawaii and spent part of his youth in Indonesia, has called himself America's first "Pacific president."?

Suspicion of US rife as White House contenders batter China

His choice of Southeast Asia for his first foreign trip since winning re-election on November 6 is meant to show he intends to make good on his pledge to boost ties with one of the world's fastest-growing regions, a strategy his aides see as crucial to his presidential legacy. It is his second extensive trek through Asia in little more than a year.?

In the centerpiece of his three-day tour, Obama on Monday will make the first U.S. presidential visit to Myanmar, also known as Burma, marking a new milestone in Washington's rapprochement with the former pariah state where a fragile transition is under way after decades of military rule.?

Prisoners freed in Myanmar ahead of Obama visit

Some international human rights groups object to the visit, saying Obama is rewarding the country's quasi-civilian government before democratic reforms are complete.?

Lending boosted by SME bundle | Business Finance News

Vince Cable, Business Secretary, has said that the ?1bn Government Business Bank is set to incorporate an agency to parcel up small firm debt and sell it to investors.

The Business Secretary said that an agency to provide business finance is in the planning stage and will be packaging loans into a number of bond types, which will come with a state guarantee that has the potential to attract a new money source into the debt market for SMEs.

The initiative would involve ?securitisation?, associated with a type of economic engineering that resulted in the crisis in the economy.

Cable spoke to The Daily Telegraph, saying that there would need to be a high degree of care shown by the Government regarding the agency?s design due to the associated risks with securitisation. He said:

?An agency is part of the current thinking. We?d need to think it through very carefully and decide exactly what role government guarantees and financial support would play.

?A new version of securitisation does have a future. Various attempts have been made to relaunch it since the financial crisis and none have quite worked. But it?s one of the ways to get money into small businesses and we?ve got to try everything because there is a serious problem of supply of finance, not just demand.?

Cable announced a Business Bank in September. The bank intends to offer an alternative finance source to SMEs.

He said that the ?1bn venture will receive support from private partners, which will provide ?10bn of finance capacity.

For a man so often painted as Toronto?s clown mayor, Rob Ford had a pretty decent day in court

TORONTO ? An audio tape of the lengthy meeting that is at the heart of the lawsuit Toronto Mayor Rob Ford is now defending makes it clear that he was obsessed with the culture of opacity, untendered contracts and back-room dealing at City Hall ? and not with the man he?s alleged to have defamed.

That man, restaurant operator George Foulidis, is now suing Mr. Ford, who was then running for mayor, for $6-million for remarks published in the Toronto Sun the day after he met the paper?s editorial board.

Curiously, and very unusually, the newspaper itself is not being sued, as is the norm.

Mr. Foulidis, 53, runs the Boardwalk Caf? on a piece of prime waterfront real estate in the eastern beaches that is owned by the city. The company?s corporate name is Tuggs Inc.

In 2010, smack in the midst of the election campaign, the outgoing council refused to reconsider its earlier approval of Mr. Foulidis?s new 20-year lease to run the restaurant, with assorted other exclusive rights ? including a lock on suntan lotion sales.

The actual contract was inked that summer.

The lease was never put out for tender despite the recommendations ? indeed, the strong urging, Mr. Ford testified Friday ? of city staff.

Mr. Foulidis alleges he was defamed by Mr. Ford, a very few of whose comments at the board meeting appeared in the next day?s paper.

At the urging of the mayor?s lawyer, Gavin Tighe, Ontario Superior Court Judge John Macdonald agreed that the entire tape, and a transcript, should be put into evidence to lend context to the disputed remarks.

That is exactly what the whole of tape does.

The allegedly defamatory remarks in the suit are a reference to ?smacks of civic corruption,? which the tape reveals Mr. Ford never said and was a paraphrase by the newspaper, and three phrases he has always admitted to saying.

From Wednesday:

The phrases are ?If Tuggs isn?t, then I don?t know what is? (allegedly a reference to corruption); ?It?s confidential and I wish you guys knew what happened behind closed doors? and that the deal ?stinks to high heaven.?

In the same paragraph, Mr. Ford also complained to the Sun staffers that ?there?s more corruption and skullduggery going on in there [closed-door meetings] than I?ve ever seen in my life.?

Ironically, because Mr. Foulidis?s lawyer, Brian Shiller, repeated those words ? corruption and skullduggery ? every five minutes and asked Mr. Ford countless questions about what he had meant or hadn?t, the phrase forms no part of the alleged defamation.

In a case like this, which is all about the specific words that are complained of, words matter hugely.

What the tape and transcript show is that the issue of Mr. Foulidis?s deal was raised late in the meeting by Sun columnist Sue-Ann Levy, who had written extensively about it.

Twice she asked Mr. Ford about ?the Foulidis contract,? and only on the second occasion did he reply, ?Wha ? On the Tuggs??

?Absolutely,? he said then. ?It?s in camera [behind closed doors], it?s confidential. I wish that you guys knew what happened in camera, which a lot of you do, obviously, but these in camera meetings, there?s more corruption and skullduggery going on in there than I?ve ever seen in my life. And if Tuggs isn?t, I don?t know what is. And I can?t accuse anyone, or I can?t pinpoint it, but why do we have to go in camera on a Tuggs deal??

Mr. Ford didn?t retreat from those words Friday, but said that by corruption and skullduggery, what he meant was the vote-wheeling and dealing by councillors, a practice he called ?horse-trading ? you scratch my back, and I?ll scratch yours. [They] trade votes off, not in an ethical way,? he said, meaning councillors sometimes didn?t read staff reports, but rather voted in support of a colleague?s pet project in exchange for a vote for one of theirs. His real bugaboo ? he mentioned it early in the Sun meeting ?? was sole-sourcing ? the general practice of not tendering contracts. He raised the subject frequently and cited two contracts ? one for subway cars ? as examples.

?I just want a competitive bid,? Mr. Ford told the Sun.

He was in the witness stand most of the day ? oddly, because of the way this trial is proceeding, called by Mr. Shiller and thus immediately cross-examined as a so-called adverse witness without the benefit of testifying first in what?s called examination-in-chief.

It?s hard enough to get the maximum contribution from your own family sometimes

This is allowable under the rules of civil procedure.

Mr. Ford wasn?t in the least a hostile witness, however, though he stood his ground ? he still believes the Tuggs? lease is a dirty deal simply because it wasn?t tendered and because of the links between Mr. Foulidis and Sandra Bussin, who was then the local councillor.

At the time, much was made in the media of about $12,000 in donations that had been made to Ms. Bussin?s 2003 and 2006 election campaigns by friends, family and staff of Mr. Foulidis.

Mr. Ford continued to express healthy skepticism that employees making $40,000, who didn?t even live in Ms. Bussin?s ward, would have coughed up the $750 maximum.

?It?s hard enough to get the maximum contribution from your own family sometimes,? he said to chuckles from the packed courtroom.

His vivid description of an in-camera meeting where he said Ms. Bussin and other councillors ?were going snake, ballistic? over staff?s recommendation that the lease be put out for tender also won a laugh.

?In camera,? he said at another point, ?is sort of an oxymoron: In camera means you?re out of the camera. There?s no public, no media.?

For the man so often painted as Toronto?s clown mayor, Robert Bruce Ford had a pretty decent day.

Voters Legalize Marijuana, States Dismiss Marijuana Cases ...

  • by Erik Altieri, NORML Communications Director November 15, 2012

Many wondered just what the exact effects of passing a marijuana legalization law would be. Some speculated no good would come of passing a state law while it is still in conflict with federal law. Now that we are a few weeks out from passing the two very first marijuana legalization measures in this country, we are beginning to have answers to these questions.

In addition to the legalization of personal possession (and cultivation of 6 plants in Colorado) that is set to go into effect on December 6th in Washington and no later than the first week of January in Colorado, we are beginning to see more positive benefits from the success of these two initiatives. Last week, two of the largest counties in Washington State, King and Pierce Counties, dismissed all pending marijuana possession cases. Clark County dismissed its cases in the days that followed. This week, Boulder County in Colorado dismissed all their pending cases and Spokane is preparing to dismiss many of theirs. It is likely that this trend will continue as we move forward and further counties in both states will also dismiss any of their pending marijuana possession cases.

So, what is the immediate result of the legalization votes on November 6th? Hundreds people will now avoid being tagged with permanent criminal records, will no longer have to appear in court and lose money and time defending themselves for a minor marijuana charge, will no longer have trouble finding employment because of a possession conviction on their record, and will no longer have to spend the mandatory 24 hours in jail that was mandated by Washington State law prior to the passage of I-502. These citizens are simply the first to benefit, there will now be tens of thousands of Americans in Colorado and Washington who won?t have to feel like criminals, pay fines, or serve jail time for the non-violent act of recreationally consuming cannabis.

And, by the way, the rest of the country is taking notice. If you haven?t heard, Rhode Island and Maine will be introducing legalization measures into their state legislatures today.

Ireland to clarify abortion rules after woman's death

DUBLIN (Reuters) - Ireland's government pledged on Thursday to clarify its abortion laws after an Indian woman who was refused a termination died from blood poisoning in an Irish hospital.

Thousands took to the streets to protest on Wednesday after news broke of the death of Savita Halappanavar of septicemia following a miscarriage 17 weeks into her pregnancy.

Activists in the overwhelmingly Roman Catholic country, which has some of the world's most restrictive laws on abortion, say the refusal by doctors to terminate the pregnancy earlier may have contributed to her death.

"I was deeply disturbed yesterday by what Savita's husband said. I don't think as a country we should allow a situation where women's rights are put at risk in this way," Deputy Prime Minister Eamon Gilmore told parliament on Thursday.

"There is no question of equivocation. We need to bring legal clarity to this issue and that is what we are going to do."

Irish law does not specify under what circumstances the threat to the life or health of the mother is high enough to justify a termination, leaving doctors to decide. Critics say this means doctors' personal beliefs can play a role.

Halappanavar was admitted to hospital in severe pain on October 21 and asked for a termination after doctors told her the baby would not survive, according to her husband Praveen.

The foetus was surgically removed when its heartbeat stopped days later, but her family believes the delay contributed to the blood poisoning that killed Halappanavar on October 28.

Praveen said he would wait for the results of an investigation before deciding whether to sue, but that Ireland's Roman Catholic tradition appeared to have been a factor in the decision to deny a termination.

"I am still in shock. It is hard to believe that religion can mean somebody's life," Praveen Halappanavar told Reuters. He said he planned to return to Ireland from India, where he traveled with his wife's body.

The Irish health authority (HSE) has launched an inquiry which the health minister said must "stand up to the scrutiny of the world." Irish media said Praveen would be interviewed.

The Indian couple were resident and working in Ireland, he as an engineer and she as a dentist.

    POLITICAL STORM

Despite a dramatic waning of the influence of the Catholic Church, which dominated politics in Ireland until the 1980s, successive governments have been loath to legislate on an issue they fear could alienate conservative voters.

Fine Gael, the senior partner in Ireland's ruling coalition, told supporters before a recent election that it would not introduce new laws allowing abortion during its five-year term, despite pressure from its junior partner Labour to act.

The government said it had received long-delayed recommendations from an expert panel on introducing new rules on abortion, and would report before the end of the month.

Four out of five Irish voters support a change in the law to permit abortion in cases where a mother's life is at risk, according to a recent opinion poll.

But a vocal anti-abortion minority has dominated the debate on abortion in Ireland in the past, with campaigners arguing that the adoption of legislation or guidelines for medical terminations would bring in abortion through the back door.

In 1992, when challenged in the "X-case" involving a 14-year-old rape victim, the Supreme Court ruled that abortion was permitted when the woman's life was at risk, including from suicide. A European Court of Human Rights in 2010 ruled that Ireland must clarify what this means in practice.

"This is exactly what the (European) court was complaining about ... The court has not said Ireland must or must not have abortion, they said they have to clarify circumstances," said Ronan McCrea, a barrister and lecturer in law at University College London.

"The vagueness ... gives excessive scope to doctors to follow their own personal views or it means even if they want to give the treatment, they'll fall foul of the law," he said.

Halappanavar's death has dominated debate in Ireland's parliament since news of it broke on Wednesday. Her photograph was spread across front pages of all Ireland's major newspapers on Thursday, while editorials demanded action from politicians.

The fact that she is a foreign national has heightened the government's embarrassment. The story was on the front of several large Indian newspapers and family members were featured on national television.

The Indian government said on Thursday it deeply regretted Halappanavar's death. "The death of an Indian national in such circumstances is a matter of concern," a spokesman said.

A new twist on an old tradition: Honeymoons with friends

    21 hrs.

When Dave Morin was planning his honeymoon to Italy and Greece with his wife-to-be Brit, he made a somewhat unconventional choice: he invited some friends.?

?A big part of our wedding was including our friends who make up our life together,? he said. ?Including our friends in the honeymoon seemed like only the right thing to do.?

Morin, a founder of tech company Path and one of the earliest employees of Facebook, is just one of a growing number of young, tech-driven entrepreneurs looking for a new twist on an old trip, according to Elite Travel International Founder and President Stacy Small, who helped Morin coordinate his trip.

Morin connected Small with 20 close friends and family members who had the option to meet up with the newlyweds for a few days in 2011 as they traveled through Santorini, Crete, Rome and the Amalfi Coast.?

All of this, of course, happened after his bride signed off on the plan. ?We definitely didn?t want to invite my parents, but we did want to invite our closest group of friends,? said Brit Morin, a tech entrepreneur and founder of Brit + Co., a "lifestyle brand that provides the digital generation with savvy shortcuts for their online and offline lives."

In the end, a few sets of friends -- and even a bit of family --?came for a few days each at different points of the two-week trip. ?Different people met us in different locations, which was really interesting, so we got a mixture of friends throughout," Brit Morin said. ?It was fantastic.??

The Morins enjoyed their trip so much that somewhere along the way they decided to change its name. They called it a ?friendmoon.?

As more and more couples live together before marriage and travel together as well, it seems the honeymoon has lost much of its significance as a couple?s first independent foray into the world-at-large. Especially for young, independent, tech-immersed individuals who may not only date for a while, but also have the financial means to travel widely on a whim. ?We dated for six years. We had been on many, many trips before,? said Dave Morin.

An inclusive honeymoon, says Small, is sort of a natural evolution from other recent wedding trends. The modern honeymoon is ?more about going somewhere to celebrate but not to go somewhere alone for 10 to 14 days. Kind of an extension of the destination wedding a few years ago.?

    But they aren't for everyone.

Dana Logstan, a California native who wed an Australian man in Santa Cruz, Calif., in September, decided to combine the destination wedding and friendmoon concepts. She planned to travel throughout the West with her new husband and his friends from home, figuring she could show them around in case they wouldn?t be back in the area any time soon.

It didn?t quite work out that way.

Her husband?s friends ended up leaving California two days early to spend more time in Las Vegas?instead of seeing Yosemite, the Grand Canyon, and other destinations boasting more natural beauty. And that turned out to be a good thing. ?I?m glad that ended up being the extent of our friendmoon, because what we realized in just that night is traveling in a big group is no fun!? Logstan wrote in an e-mail from Australia, where she now lives. ?Everyone has a different idea of what you should do with your time so everyone ends up getting frustrated with each other and there is a lot of standing around trying to decide what to do that will make everyone happy.?

Realizing they had more time to themselves, Logstan booked a last-minute trip to Mexico for a week after her wedding and enjoyed relaxing there, alone with her new husband. Had the friendmoon worked out as intended, Logstan wrote, ?I think I would've been exhausted by the end of it.? ?

In the Morins? case, visits by friends proved to be somewhat of a morale booster after they were involved in a scooter accident in Greece three days into their honeymoon; their injuries prevented them from spending much time in the sun. In the middle of the Mediterranean.?

?We spent times talking and going out to meals, rather than going out on adventures, which was the original plan,? said Brit Morin.

Of course it all depends on the friends and their sensitivity,?or lack thereof, to the fact that a honeymoon --?even a friendmoon?--?isn?t just any old vacation. ?If they?re your closest friends, they will respect that you?re on your honeymoon and that you want to have intimate moments as well,? said Brit Morin.?

Bankruptcy: Three Tips to Follow Before Filing | BankingBlawg

by josephperkins on November 14, 2012

(Bankruptcy laws in the US) As with many other major decisions and events in life, bankruptcy is one that must come with thought and preparation. It is not to be taken lightly. Many bankruptcy filers make mistakes prior to filing that can potentially damage their case and cause them to have an unsuccessful bankruptcy filing. When it comes to filing for bankruptcy, what you do not know can hurt you. Paying family members back, running up high credit card balances, and gambling prior to bankruptcy can all have a negative impact on a bankruptcy case.

Tip #1 ? Do Not Pay Back Family Prior to Filing Bankruptcy

This may seem like an unfair or unethical tip, but paying family back within the 12 months prior to your bankruptcy filing can only lead to more trouble. When you file bankruptcy your family members and friends are considered creditors just like the major bank down the street that holds your bank account and your mortgage. Paying family members or friends back gives them an unfair advantage as a creditor in your bankruptcy. In fact, bankruptcy courts frown even more so on paying back family and friends prior to filing than they do other creditors. If you owe family or friends a debt that you feel you need to pay, or have already paid in the 12 months prior to your bankruptcy filing, bring this to your lawyer?s attention immediately.

Tip #2 ? Do Not Gamble

For people experiencing financial problems it may seem like a possible quick fix to gamble in an attempt to win big and pay off debts. This is a big mistake when it comes to bankruptcy filing. Gambling losses and wins must be reported in your bankruptcy paperwork and can have a negative impact on your case. If you have been gambling in the 12 months prior to your filing, or are tempted to gamble, please discuss this with your bankruptcy attorney.

Tip #3 ? Put Away the Plastic

As tempting as it can be to use your credit cards to pay for much needed groceries, pay utility bills, or even buy a new wardrobe prior to filing this is also frowned upon. Upon receiving notice that you have filed for a personal bankruptcy, your credit card companies can review your purchase history. If they believe you intentionally ran up your balances prior to filing they can legally challenge your filing and request to have all or some of your balance removed from the bankruptcy. This means even at the end of your bankruptcy you will still be responsible for all or some of this debt.

If you are considering filing for bankruptcy it is important to consult with an experienced Cedarburg bankruptcy attorney. They can advise you of what not to do prior to filing in more detail and help fix any mistakes you may have unknowingly made. Being open and honest with your attorney is the first step in getting your financial life in order through bankruptcy.

Police: Woman stabbed children 150 times

A Naperville, Ill., woman who allegedly stabbed her son 100 times and a girl 50 times told police there were "devils" inside the children that she needed to kill, according to a prosecutor.

At 40-year-old Elzbieta Plackowska's bond hearing Thursday morning, DuPage County State Attorney Robert Berlin explained Plackowska's alleged comments. "She stated the children had evil inside of them and she was trying to drive the devil out of them," Berlin said, according to NBCChicago.com.

Police say that on Tuesday Plackowska fatally stabbed her 7-year-old son Justin 100 times and 5-year-old Olivia Dworakowski 50 times, according to the Chicago Tribune. At the time, Plackowska was babysitting her son and the girl at Olivia?s home in Naperville, about 30 miles west of Chicago, the newspaper reported. She allegedly told the kids to kneel and pray before stabbing them, NBCChicago.com reported, and also told her son that he was going to heaven.

Prosecutors say both the kids' throats were slashed, the Tribune reported.

After the murders, Plackowska tried to go to a Naperville church but found it closed, so she left a message on its answering machine saying she had done something bad and needed assistance, Berlin said, according to The Associated Press. Covered in blood?and with scratches on her hands, she went to a friend's home where her other, adult son was staying and told them that she had been robbed, Berlin said.

Prosecutors say Plackowska initially told police a stalker broke into the townhouse and committed the crimes, the Tribune reported.

Plackowska later told police that she stabbed her son to death to hurt her husband who "didn't appreciate her," according to NBCChicago.com. She said she killed the girl and two dogs because they witnessed the crime, NBCChicago.com reported.

Berlin said investigators found two blood-stained knives; one in the kitchen sink at the townhome and another in Plackowska's car, according to the AP.

"In all my years in law enforcement, this is the most gruesome and horrific crime scene that I have seen," Naperville police Chief Bob Marshall said at the news conference, according to the AP.

Plackowska?is being held without bond on two counts of first degree murder, NBCChicago.com reported. Berlin said Plackowska has no?prior history of violence,?the AP reported.
